Our top-tier Regulatory team has an excellent track record in all strategic regulatory issues in and out of court, with a focus on the energy sector. The team litigates and advises on sector specific laws and regulations, and has an unrivalled network and day-to-day dealings with policy makers, industry associations, authorities and regulators.

Energy regulatory 

Our Regulatory team has unique expertise and an outstanding track record in the energy sector, as independently acknowledged by continuous Band 1 Chambers and Tier 1 Legal 500 rankings. They represent large industrial energy consumers, energy distribution companies, energy producers, energy suppliers and energy industry associations on strategic energy regulatory and public affairs issues. The team is part of the multidisciplinary Energy team.

We are involved in:

  • the tariff regulation for electricity, gas and heat on behalf of the regional grid operators and industry associations
  • disputes regarding electricity grid congestion  
  • energy consumer claims
  • disputes regarding the qualification of electricity infrastructure and complex connection situations
  • strategic advice pertaining to private grids, smart grids and cable pooling
  • disputes regarding major accidents and grid failures
  • new legislation and policy (green hydrogen, geothermal energy, prioritising grid access and congestion management)

Environmental law

The Regulatory team also litigates and advises on the administrative law aspects of predominantly renewable energy projects (solar, wind, geothermal energy, green hydrogen, battery storage, CCS/CCSU). This includes spatial planning/planning permission, environmental law, mining law and nature conservation law.

Regulatory enforcement, subsidies, competition and EU law, sustainability and foreign direct investment issues

Furthermore, the Regulatory team is a solid defender in enforcement proceedings (market manipulation/insider information pursuant to REMIT (Regulation on Wholesale Energy Market Integrity and Transparency), the Dutch Mining Act and general environmental law). The team is also knowledgeable in subsidy matters (such as the SDE++) and competition and EU law (including State aid and public procurement), sustainability and foreign direct investment issues in the energy sector.
