Stek has successfully represented energy distribution system operator Stedin Netbeheer B.V. (“Stedin”) in fending off a civil claim of Nobian Industrial Chemicals B.V. (“Nobian”).
Before the Rotterdam District Court Nobian claimed that the court should order Stedin with transmission system operator TenneT TSO B.V. jointly and severally liable for payment of allegedly unduly paid system charges in the years 2000 and 2001.
This civil law procedure follows an administrative law procedure before the Authority for Consumers and Markets and the Administrative High Court for Trade and Industry (“CBb”) on the scope of the sector-specific dispute resolution procedure (click here for the ruling of CBb of 27 July 2021, ECLI:NL:CBB:2021:787, in Dutch).
