The Dutch law on prohibitions on pledge restrictions: some practical considerations

FIP 2025/195 – In this contribution, Merijn Batteram and Kelly Visser-Van der Vooren examine the Act on the Abolition of Pledge Prohibitions (Wet opheffing verpandingsverboden) from a practical perspective. The authors specifically address its meaning and implications for financiers and enterprises in the context of (syndicated) financings, including borrowing base financings. The statutory exception for bank accounts is also discussed.
