Stek successfully represented Dutch distribution system operator Liander in summary proceedings before the Midden-Nederland District Court against one of its customers. The customer, a houseplant grower, was causing disruptions to the electricity grid by exceeding the agreed-upon transmission capacity. After Liander announced the occurrence of grid congestion, the customer’s consultant unilaterally reduced the originally agreed transmission capacity from 292 kW to 51 kW. Liander successfully argued that by doing so, the customer had voluntarily relinquished its original capacity of 292 kW and must now adhere to the currently contracted capacity of 51 kW. The preliminary relief judge imposed a penalty payment in connection with this obligation.
