Our Aviation and Transportation team specialises in international transactions concerning the lease, acquisition, sale and financing of both commercially operated aircraft and business jets. Furthermore, we assist clients in relation to aircraft repossessions and passenger rights claims, and we advise on aviation related contracts and issues generally. In addition, our team has specific expertise in the field of aviation specific competition and regulatory issues and litigation, such as the allocation of slots and litigation vis-à-vis Schiphol Airport and ACNL, the Dutch slot coordinator.

The book provides local insight into the most pressing questions arising from the financing and leasing of aircraft. Written by international experts, Aviation Finance & Leasing covers the latest developments in developed and emerging markets and answers questions relating to the registration and title transfer of aircraft, mortgages, securities and enforcement of lease terminations, related taxes and international payment restrictions, insurance and reinsurance. Recent work highlights include the following:

  • advising Dutch regional aircraft leasing company TrueNoord in respect of the purchase and financing of various ATR and Embraer aircraft.
  • advising Dutch aircraft leasing company Mass Lease in respect of the purchase of six Fokker 100 aircraft from Portuguese operator Portugália.
  • advising Japanese listed company FinTech Global Trading Incorporated in respect of its acquisition from Seabury Capital LLC of a 51% voting interest and 44.1% economic interest in SGI Aviation Services, an independent advisor to the aviation industry, providing aircraft and engine asset management and all affiliated technical consulting and advisory service.
  • representing Corendon Dutch Airlines in various litigious matters before various courts vis-à-vis ACNL, the Dutch slot coordinator, and Schiphol Airport and before Dutch policy makers and the European Commission.
  • representing Polar Air Cargo LLC in third party indemnification proceedings brought forward by BA, KLM, Martinair, Air France, Lufthansa and Thai Airways in civil damages claim proceedings in the Netherlands related to alleged cartel arrangements in the air cargo industry.
  • representing Transavia before the General Court of the European Union in a state aid case relating to Transavia’s activities at Pau Airport in France.
  • advising Connexxion on various corporate, commercial, competition law and litigious matters.
  • representing several towage companies in antitrust investigations.
