Stek successful in first Large Chamber procedure CBb

On 25 March 2015 the Administrative High Court for Trade and Industry (CBb) rendered a judgment in its first Large Chamber proceeding. The proceeding concerns administrative fines for violation of the confidentiality obligations of energy distribution company Liander, imposed by the Authority for Consumers and Markets. The CBb has quashed the fines and has ruled that a distribution company only violates its confidentiality obligations if it can be attributed to that company that the confidential information is disclosed.
