Stek lunch break webinar: The New Dutch FDI Regime

On Wednesday 30 November 2022 at 12.30 p.m. CET Stek offers a webinar for lawyers based outside the Netherlands that are interested in the new Foreign Direct Investment (FDI) screening legislation in the Netherlands. Mattijs Baneke of Stek’s Competition Team will provide an overview of the cross-sector FDI rules that will enter into force at the end of Q1 2023. We are very pleased that Mattijs will be joined by Yasin Ince, Screening Official at The Netherlands Bureau for Investment Screening, the bureau that will receive and handle FDI notifications. Yasin will be interviewed by Mattijs and will clarify the agency’s view on the new FDI rules.

Like other EU Member States, the Netherlands has adopted new rules on FDI screening. Under the Investments, Mergers and Acquisitions Security Screening Bill (ISSB), that will take effect in Q1 2023, certain transactions must be notified to The Netherlands Bureau for Investment Screening prior to their completion. Lawyers who advise on transactions involving companies that are (partially) based in the Netherlands will therefore have to take these new rules into account.

In approximately 45 minutes, Mattijs and Yasin will discuss the most relevant topics in relation to the new FDI regime, including:

  • the scope of the ISSB;
  • the retroactive effect of the ISSB;
  • procedural aspects;
  • the substantive assessment.
