Stek advises DELTA on Dutch Energy Agreement

Stek has advised multi-utility company DELTA on the competition law aspects of the Dutch Energy Agreement, in particular regarding the obligatory closure of coal-fired power stations which were built in the Netherlands in the eighties of the previous century. DELTA owns and exploits indirectly, through joint production company N.V. Elektriciteits-Produktiemaatschappij Zuid-Nederland EPZ, one coal-fired power station (the BS-12) built in the eighties. On 26 September 2013 the Dutch Competition Authority published an analysis in which it concludes that the obligatory closure of coal-fired power stations is likely to be in violation of the Dutch and European cartel prohibition.
